GET CHAUFFEURED PRIVACY POLICY
This document explains how and why we collect, use, hold and disclose personal information and is referred to as our Privacy Policy.
This Privacy Policy applies to all personal information collected by Get Chauffeured ABN 91 080 211 132 of Suite 1015/377 Kent Street, Sydney, New South Wales, 2000 (Get Chauffeured, ‘we’ or ‘us’) via telephone communications, email correspondence and the website located at www.getchauffeured.com.au. We adhere to the Australian Privacy Principles (APP) under the Privacy Act and the Notifiable Data Breaches Act.

1. What is ‘personal information’?
‘Personal information’ is information or an opinion about an identified individual or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
2. Consents
By providing us with your personal information via telephone communications, email correspondence or by use of our website and digital platform, you hereby consent to our Privacy Policy and agree to its terms and conditions.
3. What types of personal information do we collect?
We will only collect personal information about you by lawful and fair means and not in an unreasonably intrusive manner. The kind of personal information that we may collect and hold includes contact information (e.g. name, email address, and mobile phone number), age, postal addresses, business addresses, personal addresses, claim numbers, flight numbers, journey details, photographs, employment history, educational qualifications, Commonwealth identifiers (e.g. apprenticeship numbers) and financial information (e.g. credit card details).
4. How we collect your personal information
Information that you specifically give us
We may ask you to provide us with certain types of personal information if you wish to obtain a particular service or product from us. This might happen over the telephone, text, email, through our website and digital platform, by filling in a paper form, or meeting with us face-to-face. We will give you a Collection Notice at the time, to explain how we will use the personal information we are asking for. The notice may be written or verbal.
You might also provide your personal information to us, without us directly asking for it, for example if you engage with us on social media.
Information that we collect from others
If you apply for a job or contract with us, we will collect personal information about you from your referees. With your consent we may also use a third-party service to ensure your employment, educational and identity records are valid. We may also check some details about our suppliers from publicly available sources, such as the Australian Business Register and ASIC databases.
Information that we generate ourselves
We maintain records of the interactions we have with you, including the products and services we have provided to you, support that has been provided for you and complaints that have been made. We collect limited information about users of our websites, for diagnostic and analytic purposes.
5. ‘Cookies’, Automated technologies or interactions
If we collect personal information from you via our website, we may use digital cookies to remember your preferences and collect online traffic data and browsing characteristics. Internet cookies are digital identifies that are stored on your computer. The browser stores the message in a text file which is sent back to the server each time the browser requests a page from the server. Cookies and other information collection technologies can only store information that is explicitly provided by the user or visitor in the first place, or information which is already known to the website such as your IP address. You can choose to adjust your browser to reject cookies or to notify you when they are being used, bearing in mind that rejecting cookies can result in a loss of some website functionality.
We may use automated tools (e.g. booking allocation algorithms) to assist with scheduling and service delivery. These tools do not make decisions without human oversight that significantly affect individuals.
6. Links to other sites
On our website, we may provide links to third party websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of companies linked to our website. 7. How we use personal information
We may use personal information for the following purposes:

• to answer your enquiry about our services, or to respond to a complaint;
• to manage our business relationship with you;
• to enhance your service experience or communications with us, including personalising content based on your interests, improving our website, and efficiently responding to customer service requests;

• to promote our products or services which may be of interest to you (unless you have opted out from such communications;
• to analyse trends, conduct research and understand enhancements we could offer to our business and services;
• to comply with legal, contractual and regulatory obligations; or
• for other purposes with your consent obtained through the provision of a Collection Notice or verbally, unless you withdraw your consent.
8. When we disclose personal information
Our third-party service providers
We customarily disclose personal information only to our service providers who assist to deliver the services and support you have requested or in operating and analysing the website.
Your personal information may also be accessed from time to time by maintenance and support personnel acting in the normal course of their duties.
Other disclosures and transfers
We may also disclose your personal information to third parties for the following purposes if necessary to provide the service or product you have requested, if otherwise permitted or required by law or for other purposes with your consent.
9. Retention of data
By providing us with your personal information, you hereby acknowledge and consent to the retention and storage of any personal information that you provide us for an indefinite period, subject to any applicable laws and regulations.
10. Access and correction
Australian Privacy Principle 12 permits you to obtain access to the personal information we hold about you in certain circumstances, and Australian Privacy Principle 13 allows you to correct inaccurate personal information subject to certain exceptions. 11. Overseas transfers
We may store, process or back up your personal information on servers that are located overseas. Some of our third-party service providers may store or process data overseas (e.g., in the United States, EU or any other overseas country). Where this occurs, we will take reasonable steps to ensure that those providers comply with privacy obligations equivalent to the APPs.
Important Notice: By submitting your personal information to us, you expressly consent to the disclosure, transfer, storing or processing of your personal information outside of Australia. In providing this consent, you understand and acknowledge that countries outside of Australia do not always have the same privacy protection obligations as Australia in relation to personal information. You consent to us providing your personal information to recipients outside of Australia even though that recipient is not bound by the Privacy Act, will not be accountable to you or to us for breaches of the Privacy Act and you will not have the redress options available to you under the Privacy Act. If you do not agree to the transfer of your personal information outside of Australia, please either do not provide us with your personal information or contact us via the details set out at the end of this document.
12. Protection under foreign laws
In some circumstances, foreign data protection laws may have extra-territorial application in Australia and may provide additional protection to individuals if we have collected their personal data from an overseas jurisdiction. Where this is the case, there may be additional rights and remedies available to you under the foreign law.
13. Children’s privacy
We do not knowingly collect personal information from children. If you are a parent or guardian and believe that your child has provided us with personal information, please contact us, and we will promptly delete such information from our systems.
If your child and/or children provide us with their personal data, you agree to indemnify us against any claims, damages, or liabilities arising from such data submission. We deny any responsibility or liability for the actions of children providing their data without appropriate parental or legal guardian consent.
14. Security of your personal information
We will take reasonable security measures to protect personal information from loss, unauthorised access, use, modification or disclosure. We will take reasonable steps to ensure personal information is stored securely, not kept longer than necessary, and disposed of appropriately.
Our website and platform is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. All personal information (save for credit information) is processed through our gateway provider and is stored off-site and on our internal NAS hard drive.
All credit information you supply is encrypted via Secure Socket Layer (SSL) technology and is compliant with Payment Card Industry Data Security Standards. We implement a variety of security measures when a user places an order to maintain the safety of your personal information. All transactions are processed through a gateway provider.
Certain functionalities of our services may involve interactions with third-party platforms, services, or applications. While we take rigorous measures to protect your privacy within the scope of our platform, it is important to note that we cannot guarantee the security systems of third parties and will not or be held responsible for breaches of privacy that may occur in circumstances beyond our control, specifically related to third-party sharing.
Our services may also integrate with or utilise third-party applications, plugins, or services for enhanced functionality. These third parties may have their own privacy policies and practices. You are encouraged to review the privacy policies of any third-party platforms or services they choose to interact with through our website or platforms. The terms and practices of these third parties are beyond our direct control. In instances where you willingly share personal information with third-party services through our platform, we cannot be held accountable for the subsequent use or protection of that personal information. You hereby agree to indemnify and hold us harmless from any claims, damages, or losses arising from interactions with third-party services facilitated through our platform.
15. Data breach
A data breach occurs when personal information is accessed, disclosed without authorisation, or is lost. For example, when a database containing personal information is hacked. We acknowledge our obligations under the Notifiable Data Breaches (NDB) scheme.
If a data breach occurs, we will attempt to contain any breach as soon as practically possible. How we ensure a data breach is contained will vary on a case-by-case basis but may include the following protocols:
1. suspending compromised accounts;
2. removal of malware, where identified;
3. temporary platform downtime if necessary;
4. the recovery of any lost data, if possible;
5. repairing unauthorised modification of data, if possible; and
6. restoring access to the platform when possible.
If a data breach is likely to result in serious harm, we will notify affected individuals and report the breach to the Office of the Australian Information Commissioner (OAIC) in accordance with the NDB scheme.
Whilst we will attempt to contain any data breach, we do not accept liability for any data breaches which occur in connection with computer viruses, data corruption, delay, interruption, unauthorised access, or unauthorised amendment.
16. Coverage
All employees, contractors, and individuals participating in the operations of our business are subject to the terms outlined in this Privacy Policy. Through their affiliation with the Company, staff, contractors, and other stakeholders are covered by and must adhere to the terms and conditions specified in this Privacy Policy.
17. Doxxing
Doxxing refers to the publication or disclosure of an individual’s personal information without consent with the intent or effect of causing harm, harassment, intimidation or distress. We will not knowingly collect, publish or facilitate the publication of personal information in a way that could lead to harm or harassment.
In addition, we strictly prohibit any use of our systems or services to dox, expose or maliciously share another participant’s information. This includes sharing private or identifying information without consent, encouraging others to target a person based on shared data or uploading or linking to content designed to expose someone’s identity against their will.
We will take all reasonable steps to remove or restrict access to any personal information that is disclosed in breach of this Privacy Policy or the Privacy Act. If you believe your personal information has been doxxed or misused in connection with our services, please contact our Privacy Officer on the details below. We may also report serious doxxing incidents to the Office of the Australian Information Commissioner (OAIC) and law enforcement as appropriate.
18. Accessing or correcting your personal information
You have the right to request access to the personal information that we hold about you. Unless an exception applies, we must allow you to see the personal information we hold about you, within a reasonable time period and without unreasonable expense.
You also have the right to request the correction of the personal information we hold about you. We will take reasonable steps to make appropriate corrections to personal information so that it is accurate, complete and up-to-date. Unless an exception applies, we must update, correct, amend or delete the personal information we hold about you within a reasonable time period. We do not charge for making corrections.

19. Updates to this policy
We will review this policy regularly and may update it from time to time. We reserve the right to change and modify this privacy policy at any time without prior notice. Your continued use of our services following the posting on our website of changes to these terms means you accept these changes. You will always have access to the most recent policy on https://www.getchauffeured.com.au/.

While we endeavour to resolve complaints quickly and informally, if you wish to proceed to a formal privacy complaint, we request that you make your complaint in writing to our Privacy Officer, by email as above. We will acknowledge your formal complaint within 10 working days.
If we do not resolve your privacy complaint to your satisfaction, you may lodge a complaint with the OAIC by calling them on 1300 363 992, making a complaint online at www.oaic.gov.au, or writing to them at OAIC, GPO Box 5218, Sydney NSW 2001.
